Defamation

  • Defamation is injuring the reputation of a person in front of a third party.
  • If defamation happens through spoken words or gestures, it is termed Slander and if it takes place in a written format it is called libel.
  • In India, definition is covered by both the criminal law and the Civil law. While criminal law is well codified in IPC, the Civil law of defamation is not so well codified is derived from English common law.
  • According to Section 499 of the IPC, defamation may be by words, either spoken or intended to be read, or by signs or visible representation.

FIR

  • First information report is a written document prepared by police organization.
  • An information given under sub-sec (1) of section 154 of CrPC (codes of criminal procedure) 1973 is commonly known as FIR.

Contempt of court 19711

The Contempt of courts Act 1971 gave effect to the accepted recommendations of the โ€˜Sanyal committee 1961โ€™.

  • Section 2 (a) – ‘Contempt of Court’ means civil contempt or criminal contempt.
  • Section 2 (b)- ‘Civil contempt’ means willful disobedience to any Judgment, decree, direction, order, writ or other process of a court or willful breach of an undertaking given to a court.
  • Section 2 (c) – ‘criminal contempt’ means the publication (weather by words, spoken or written, or by signs, or by visible representation) of any matter.

Sedition

  • Sedition is the illegal act of inciting people to resist on rebel against the government in power.
  • Sedition 124-A is the Indian Penal Code, named โ€˜Seditionโ€™.
  • The Crime of saying, writing or doing something that encourages people to disobey their government.
  • The law was originally drafted by Thomas Macaualy.
  • Example- In the Year 2014, some of the Kashmir students were charged with the sedition for supporting Pakistan in a cricket match between India and Pakistan.
  • Sedition is the illegal act of inciting people to resist or rebel against the govt. in power.
